Institute authorized to protect the rights of entrepreneurs (Ombudsman) under the President will be established in Belarus. The corresponding document is being prepared by the National Bank.

At the beginning of the year the business community of Belarus has initiated the creation of the institute authorized to protect the rights of entrepreneurs under the President. According to the representatives of Belarusian business, in Russia such an institution has been operating since 2012, and as the business environment of both countries is the same, entrepreneurs of Belarus are also in need of a defender.
We are a member of the Union State, the Customs Union, so the rights of Belarusian business entities must be protected as well as in Russia and Kazakhstan, – said Chairman of PA Minsk Capital Union of Entrepreneurs and Employers (MCUEE) Vladimir Karyagin.

After some negotiations with the representatives of the Belarusian authorities, the initiative of the Belarusian business was adopted.
According to head of the legal department of MCUEE Vadim Borodulya, now the National Bank is preparing a draft regulation to control the activities of the institute authorized to protect the rights of entrepreneurs. Moreover, the business unions have managed to ensure that candidates for the post of the Ombudsman will be submitted for the President’s consideration by the business community.

Russian experience in the work of the Business Rights Commissioner is planned to be taken as a base. The Ombudsman will be directly subordinate to the President and will be able not only to apply to the courts, bypassing various intermediate instances, but also to appoint public assistants and regional representatives.
It is likely that the Ombudsman will also have the right to visit entrepreneurs and businessmen, who are convicted or under investigation, without special permission. Entrepreneurs will also be able to complain to the authorized person, supposing that the issue will be reported to the President.
Besides, it is expected that the Ombudsman will be another mechanism to combat corruption, as the President has already said.

There is no concrete time limit for preparation of the provision to regulate activities of the Ombudsman. However, it is mostly important, that the issue has been finalized, and the rest of it is just nuances.
