Amendments have been made to the Law of the Republic of Belarus "On Public-Private Partnership" dated December 30, 2015 No. 345-Z.

The amendments are aimed at improving the legal conditions for the implementation of the mechanism of public-private partnership (hereinafter – PPP) in the republic. The amendments were prepared on the basis of practical experience in the development and review of the documentation of the first PPP project – the project for the reconstruction and maintenance of the object "M-10 Highway the border of the Russian Federation (Selistche) – Gomel – Kobrin km 109,9 – km 195,15" and analysis of international regulatory experience in this field.

 The key changes to the Law are:

– introduction of the institute of direct negotiations with the investor. The negotiations will act as an alternative to the competitive procedure for determining a private partner and will help simplify the passage of the process by the project before concluding a PPP agreement.

– reducing the number of government agencies involved in the preparation and coordination of drafts. In particular, drafts financed only from local budgets will not be coordinated with the Ministry of Finance and the Ministry of Economy. The change will shorten the preparatory period and speed up the start of projects.

The main provisions of the new version of the Law will come into force 6 months after its official publication. Also, within a six-month period, the Council of Ministers will determine the procedure for organizing and conducting direct negotiations.
